TERMS AND CONDITIONS

Information on how to enter and the prize form part of these Terms and Conditions. Participation in this Pearler Promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.

ELIGIBILITY

The Promotion is open to all Pearler users aged 18 and over. The Promoter is Pearler Investments Pty Ltd.

Employees (and their immediate family and/or those living in the same household) of the Promoter, and its respective affiliates, subsidiaries, agencies and suppliers associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

HOW TO ENTER

The Promotion period commences at 7am AEST on Friday 18 February 2022 and ends at 11:59pm AEST on Friday 4 March 2022. (“Promotional Period”).

To enter, individuals must complete the entry via the following actions:

1. Follow @girlsthatinvest & @pearlerhq on Instagram or TikTok.
2. Create a free Pearler account with the code girlsthatinvest (or via pearler.com/gti-x-pearler).

International Entrants

At the moment, Pearler is an Australia-based company. Participants who do not live in Australia are eligible to enter. They can do so by creating a Pearler account and listing their contact details. If an entrant outside of Australia should win, they will receive the prize funds when Pearler launches in their country. Should Pearler fail to launch in their country within three months of the competition ending, Pearler will deposit the funds with their nominated broker.

Determining and Notifying the Winner

Selection of the winner (the “winner”) will be undertaken by the Pearler team on Wednesday 9 March 2022.

The Promoter’s decision is final and no correspondence will be entered into. The winner will be notified via email on Wednesday 9 March 2022. The winner must acknowledge acceptance of and claim their Prize by replying to this email with details requested. This must be received by the Promoter no later than Wednesday 16 March 2022.

The winner will only be able to claim their prize via a valid Pearler account accessible at www.pearler.com and accepting Pearler’s standard terms and conditions including identification checks. Should the winner reside in a country in which Pearler will not launch within the next three months, Pearler will transfer the prize to the winner’s designated broker. If for any reason a winner does not acknowledge, accept and claim their Prize by 16 March 2022, the Prize will be forfeited and another winner selected.

The Promoter will have no liability for a winner's failure to receive notices due to winner’s spam, not checking Instagram DMs, junk email or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information.

Anything not listed in the above prize details and value is not part of the prizing.

Prizing cannot be negotiated or traded in for something else.

Pearler is not responsible for the outcome of the allocated Pearler Credit use.

Non-Australian winners will be eligible to transfer their Pearler Credit to their designated broker only if Pearler has not launched in their country within three months of the winning date.

GENERAL

Pearler Investments Pty Ltd (“Pearler”) (ABN 625 120 649) will be collect entrants details who commence the questions on the survey form. Entrants consent to their name and email address being used for this purpose.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence).

The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

If a winner of the Prize is under the age of 18 years, the Prize will be forfeited by that entrant, and a redraw will occur.

In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize. The Promoter reserves the right to modify, suspend or terminate the Promotion without notice.

As a condition of accepting the Prize, each winner must sign any legal documentation in the form required by the Promoter, and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

By entering the Promotion, entrants agree to be contacted by Pearler via email.

Entrants and the winner should note that:

The prize does compel or oblige the winner to invest and that any investment gives rise to specific risks and the value of the investment may go down as well as up;

There can be costs and tax implications associated with investing, receiving distributions and disposing of an investment; and The Promoter nor Pearler are not licensed to provide personal financial advice to any entrant or the winner.

Before making an investment decision, entrants should do their own research or obtain financial advice in light of their individual circumstances; and
